This online store (the “Store”) is operated by ETC Marketing (the “Operator”) as the authorized spirit-wear and uniform store for Orlando Junior Academy Store (the “School”). By accessing the Store or placing an order you agree to these Terms of Use, our Privacy Policy, and our Refund & Return Policy, which are incorporated into these Terms.
Custom, made-to-order products
All products are custom printed or embroidered on demand. Production may take up to 4 weeks, plus shipping. Product images are illustrative; minor variations in color, placement, and sizing are normal for decorated apparel and are not defects. All sales are final except as stated in the Refund & Return Policy.
Ordering and payment
Prices are displayed at checkout and charged in USD by the Operator through its payment processor. You represent that you are at least 18 years old and authorized to use the payment method provided. Applicable sales tax and shipping charges are added at checkout. We may refuse or cancel any order for suspected fraud or error; if we cancel a paid order, it will be refunded in full.
School marks
School names, logos, mascots, and marks appearing on products are the property of the School and are used by the Operator and its production partners under authorization from the School, solely for products sold through the Store. No right or license in any mark is granted to purchasers.
Disclaimer of warranties
THE STORE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, THE OPERATOR, THE SCHOOL, AND THEIR RESPECTIVE PARTNERS, VENDORS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE OPERATOR, THE SCHOOL, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, LICENSORS, VENDORS, AND SERVICE PROVIDERS ARISING OUT OF OR RELATING TO THE STORE OR ANY ORDER SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM, AND NONE OF THEM SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Indemnification
You agree to indemnify, defend, and hold harmless the School, the Operator, and their respective affiliates, officers, directors, employees, agents, partners, licensors, vendors, production and fulfillment partners, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Store, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.
General
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, and any dispute shall be brought exclusively in the state or federal courts located in Florida. If any provision is held unenforceable, the remainder stays in effect.
